1. Introduction

Welcome to CarzooL ("Company," "we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of the CarzooL platform, including our website, mobile applications, and WhatsApp-based services (collectively, the "Platform").

By accessing or using our Platform, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Platform.

2. Platform Description

CarzooL operates as a marketplace platform that connects customers seeking automotive services ("Customers") with independent service providers ("Providers"). We facilitate communication and connection between parties but do not provide automotive services directly.

Important: CarzooL is not a service provider, mechanic, towing company, or automotive service business. We are a technology platform that enables connections between Customers and independent Providers.

3. No Platform Fees

CarzooL does not charge Customers any fees for using the Platform to request services or receive quotes. Any fees, charges, or payments for services are made directly between the Customer and the Provider. CarzooL does not collect, process, or handle payments for services rendered by Providers.

4. Disclaimer of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CARZOOL EXPRESSLY DISCLAIMS ALL LIABILITY FOR:

• The quality, safety, legality, or any other aspect of services provided by Providers
• Any damages to your vehicle, property, or person resulting from services provided by Providers
• Any disputes between Customers and Providers
• The accuracy of quotes, estimates, or pricing provided by Providers
• The qualifications, licenses, insurance, or certifications of Providers
• Any delays, failures, or inability of Providers to perform services
• Any loss, theft, or damage occurring during or after service provision
• Any indirect, incidental, special, consequential, or punitive damages

5. Independent Providers

All Providers on the CarzooL Platform are independent contractors and are not employees, agents, or representatives of CarzooL. Providers are solely responsible for:

• Maintaining appropriate licenses, permits, and certifications required by law
• Carrying adequate insurance coverage for their services
• Complying with all applicable laws, regulations, and industry standards
• The quality and safety of their work
• Their own tax obligations and business operations
• Any warranties or guarantees they offer for their services

6. No Warranty

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Platform will be uninterrupted, secure, or error-free, or that any defects will be corrected. We do not guarantee the availability of any Provider or the acceptance of any service request.

7. Customer Responsibilities

As a Customer, you agree to:

• Provide accurate and complete information when requesting services
• Verify the credentials, insurance, and qualifications of Providers before engaging their services
• Negotiate and agree upon pricing directly with Providers before services begin
• Inspect completed work and address any concerns directly with the Provider
• Make payments directly to Providers as agreed
• Use your own judgment when selecting and engaging Providers

8. Indemnification

You agree to indemnify, defend, and hold harmless CarzooL, its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:

• Your use of the Platform
• Your interactions with Providers or other users
• Any services provided by Providers
• Your violation of these Terms
• Your violation of any applicable law or regulation

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL CARZOOL BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• Your use or inability to use the Platform
• Any conduct or content of any Provider or third party on the Platform
• Any services obtained through the Platform
• Unauthorized access, use, or alteration of your information

IN NO EVENT SHALL CARZOOL'S TOTAL LIABILITY TO YOU EXCEED ONE HUNDRED DOLLARS ($100).

10. Dispute Resolution

Any disputes between Customers and Providers must be resolved directly between those parties. CarzooL is not responsible for mediating, arbitrating, or resolving any disputes arising from services provided through the Platform.

Any disputes between you and CarzooL shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. You agree to waive any right to participate in a class action lawsuit or class-wide arbitration.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.

12. Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify users of any material changes by posting the updated Terms on this page with a new "Last updated" date. Your continued use of the Platform after any changes constitutes acceptance of the modified Terms.

13. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.
